FISHERIES MANAGEMENT DIRECTIONS

FOR THE GWAII HAANAS HAIDA HERITAGE SITE

UPDATED AND REVISED – Dated 13 June 2019

 These directions amend the “Council of the Haida Nation Fisheries Management Directions for the Gwaii Haanas Haida Heritage Site (dated 30 April 2019)” to adjust coordinates and present fisheries closures in a user-friendly format. The full corrected directions follow.

AUTHORITY

Gwaii Haanas, including the land and the sea, is subject to the collective and individual rights of the Haida citizens, the sovereignty of the Hereditary Chiefs, and jurisdiction of the Council of the Haida Nation. The Haida Nation owns these lands and waters by virtue of heredity, subject to the laws of the Constitution of the Haida Nation and the legislative jurisdiction of the Haida House of Assembly.

The Haida Nation has designated and managed Gwaii Haanas as the “Gwaii Haanas Haida Heritage Site”, and thereby will maintain the area in its natural state while continuing a traditional way of life for countless generations. In this way the Haida Nation will sustain the continuity of Haida culture while allowing for the enjoyment of visitors in Gwaii Haanas.

MANAGEMENT

The Gwaii Haanas Archipelago Management Board (AMB) recently completed the Gwaii Haanas Gina ’Waadluxan KilGuhlGa Land-Sea-People Management Plan (2018). The plan increases protection of the marine area, confirms and strengthens the role of the AMB in fisheries management, and commits to managing all fisheries to the highest standard using an ecosystem-based management (EBM) framework.

Zoning of marine areas in the plan, including strict protection and multiple use zones, determines where fisheries can occur, and the EBM Framework determines the conditions under which they can occur. Together they inform AMB direction for fisheries management in Gwaii Haanas.

With approval of the plan, zoning for Gwaii Haanas is complete. The Haida Nation and Canada have agreed that fisheries closures for Gwaii Haanas will be implemented using Haida and federal tools, processes and authorities.

Work on the EBM framework is ongoing. The AMB are aiming to complete the framework (including the identification of specific, measurable objectives and a process to evaluate Gwaii Haanas fisheries against these objectives) by 2020. All fisheries in Gwaii Haanas are expected to be evaluated by 2021.

This document implements the strict protection zones approved in the Gina ’Waadluxan KilGuhlGa Land-Sea-People Management Plan (2018) under Haida authority provided by the Constitution of the Haida Nation (2018) and the Gwaii Haanas Marine Agreement (2010). When the EBM framework and evaluation is complete, additional fisheries management directions applicable to the multiple use zones in Gwaii Haanas may also be implemented.

FISHERIES CLOSURES

Effective May 1, 2019, all commercial and recreational fishing will be prohibited in the strict protection zones identified in the Gwaii Haanas Gina ’Waadluxan KilGuhlGa Land-Sea-People Management Plan (2018).

This includes the following commercial and recreational fishing activities:

  • all salmon by gill net, purse seine net and hook and line;
  • all pelagics by gill net, purse seine net and hook and line including: tuna, herring, sardine;
  • all invertebrates by diving, gill net, hand picking, hook and line, seine, trap and trawl net including: geoduck and horse clams, red sea urchin, green sea urchin, sea cucumber, euphausiid, intertidal clam, razor clam, shrimp, prawn, Pacific oyster, crab, scallop, octopus;
  • all groundfish by trap, mid-water trawl, bottom trawl, hook and line and jigging including: sablefish, halibut, rockfish, lingcod, dogfish, skate, sole, turbot, hake, cod and pollock.

These directions do not apply to Haida traditionally based use in Gwaii Haanas. Traditionally based use is allowed in all zones in Gwaii Haanas, consistent with the Constitution of the Haida Nation and section 35 of the Constitution Act.

These closures will be in effect until further notice.
